Dear Commissioner Wells:
I thought it might be helpful to share with you a few thoughts as you begin to consider submissions for Phase II of your inquiry.
First, I compliment you on the handling of the first phase of your inquiry. Your work on this very complex and difficult matter has shown compassion, transparency, and a careful regard for the many important issues. You have also produced a comprehensive Phase I report, which has already led to changes and made travel to and from the offshore oil rigs safer.
You will recall that in Phase I, questions arose regarding overlap between your inquiry and the TSB investigation. At that time, our respective mandates were discussed and your terms of reference were crafted to make a clear distinction. However, as you undertake the second phase of your inquiry, questions may arise again and there may be pressure for you to examine certain areas that fall outside of your mandate.
I understand that in Phase II you will only undertake a review of the sections of the TSB report that deal with matters specifically within the mandate of the Canada-Newfoundland and Labrador Offshore Petroleum Board. In that regard, I highlight that our two independent processes have identified a number of similar concerns in the areas of survivability. It is my hope that your continuing work will complement two of our recommendations: the first on Safe Ditching and Successful Evacuation and, the second on Emergency Underwater Breathing Apparatus. I also suggest a review of the TSB Findings as to Risk - numbers fourteen through twenty-three - as I believe these areas also overlap the scope of your inquiry. These are areas where our collective efforts can make a difference and enhance safety for workers in the offshore.
At the end of the OHSI inquiry, when you have completed your final deliberations, I am certain that the result will be improved safety for workers in the offshore oil industry. Through our combined efforts we will have made compelling arguments for change.
If there is anything further you require from the TSB, you have only to ask. In the meantime, I wish you well in Phase II and look forward to your final report.
